Terms of Service

Effective date: May 9, 2026
Last updated: May 9, 2026

These Terms of Service (“Terms”) govern your use of www.3psafetyinspections.com (the “Site”) and any inspection services you engage from 3P Safety Inspections, a division of 3P Safety Services (“3P Safety Inspections,” “we,” “us,” or “our”). By using the Site or engaging our services, you agree to these Terms. If you do not agree, do not use the Site or our services.

These Terms are intended for business clients and the adult professionals who represent them. Our services are not intended for consumers as that term is defined under federal or state consumer protection law. They form a binding agreement between you and 3P Safety Inspections covering your access to the Site and any inspection engagement we do on your behalf.

1. Services

3P Safety Inspections provides crane and lifting equipment inspection, evaluation, and reporting services. The scope of any specific engagement, including equipment to be inspected, applicable standards, deliverables, location, fees, and timing, is set out in a written quote, statement of work, or service agreement (collectively, the “Engagement”). The Engagement controls if anything in it conflicts with these Terms.

We do inspections in accordance with applicable federal, state, and industry consensus standards including OSHA 29 CFR 1910.179, 29 CFR 1926.1412, the ASME B30 series, ANSI A92, and EM 385-1-1 where applicable to government and military projects. We do not do repairs, modifications, or remediation. Our role is independent inspection and documentation only.

2. Quotes and scheduling

Quotes are valid for 30 days from issuance unless stated otherwise. A quote becomes a binding Engagement when accepted in writing (email is enough) and the scheduled inspection date is confirmed by both parties. Scheduling is offered on a first-confirmed, first-served basis. Same-day or expedited scheduling is subject to inspector availability and may carry expedited fees disclosed in the quote. Cancellation within 48 hours of the scheduled inspection date may incur a documented mobilization fee equal to actual costs incurred up to that point.

Rescheduling is generally accommodated without charge with at least 72 hours’ notice.

3. Client responsibilities

To enable the inspection, you agree to provide safe site access and any required PPE coordination. Make sure equipment is in a configuration suitable for inspection. Provide complete and accurate equipment documentation, prior inspection records, and operator/maintenance personnel as needed. Coordinate any required permits, escorts, and security clearances (especially for federal, military. Or restricted-access sites). And pay invoices on the terms in Section 5.

You also agree to disclose any known existing deficiencies, recent modifications, or pending repairs before the inspection so the inspector can plan accordingly. If site conditions prevent the inspection from being completed safely or in accordance with the Engagement, we may reschedule and charge a documented mobilization or standby fee. You bear sole responsibility for the safety of personnel and operations at your site, before, during, and after our inspection visit.

4. Inspection deliverables

We deliver a written, photo-documented inspection report identifying the equipment inspected, applicable standards referenced, observations and findings, deficiency severity classifications, and recommended corrective actions. Reports are typically delivered within 5 business days of the field inspection unless the Engagement specifies otherwise. Reports are signed by a named NCCCO-certified inspector and include the inspector’s certification number for traceability. Photographs are included for documented findings, and reference standards are cited for each cited deficiency.

Inspection reports describe the condition of the equipment as observed at the time and location of inspection. They are not warranties of future performance, fitness for a particular purpose, or merchantability. Equipment condition can change rapidly with use, environment, and maintenance practices, and the report’s findings should be considered current only on the date of inspection. Reliance on a report past its date of inspection requires re-evaluation by a qualified person.

5. Fees, invoicing, and payment

Fees are stated in the Engagement. Unless stated otherwise, invoices are due net 30 from invoice date. Late balances accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law. We may withhold release of inspection reports for accounts more than 60 days past due. Travel expenses for remote sites and off-state mobilizations may be billed at cost or at a flat per-trip fee disclosed in the Engagement. We accept payment by ACH, check, and major credit cards.

Specific payment terms for federal and government clients follow the applicable contracting authority’s invoicing procedures.

6. Independence and confidentiality

We do inspection services independently. We do not accept compensation from equipment manufacturers, service providers, or repair vendors that would compromise our objectivity. Inspectors may not solicit follow-on work for affiliated repair providers, and we do not maintain ownership stakes or referral arrangements with crane manufacturers or rebuilders. We treat all client equipment data, facility information, and inspection findings as confidential.

We will not disclose specific findings to third parties without your written consent except where required by law, regulation. Or by the inspection report’s intended audience (for example, a project owner who commissioned the inspection). When inspection findings must be reported to a regulator or law enforcement under legal obligation, we will notify the affected client to the extent permitted by law, and we will limit disclosures to the minimum necessary to comply.

7. Intellectual property

We retain ownership of our inspection methods, checklists, templates, software, and any general know-how developed through our services. You receive a perpetual, non-exclusive, non-transferable license to use the inspection report we deliver to you for your internal compliance, audit, and operational purposes, including sharing with your insurer, regulators, project owners, and legal counsel. You agree not to reproduce, redistribute, or commercialize our reports except as reasonably needed to operate your business and comply with regulatory obligations.

The Site and its content (excluding third-party trademarks) are owned by 3P Safety Inspections and protected by US and international intellectual property laws. Republication, scraping, or syndication of Site content without written permission is prohibited.

IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL. Some jurisdictions do not allow limitations on implied warranties or exclusion of incidental or consequential damages. So some of the limitations above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless 3P Safety Inspections, its affiliates, and its inspectors from third-party claims, damages, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of inspection reports outside the license in Section 7. (b) your equipment, facilities. Or operations; (c) information you provide that is inaccurate or incomplete. Or (d) your breach of these Terms.

We will provide reasonable cooperation in defending any indemnified claim, and you may not settle any indemnified claim that imposes liability or obligation on us without our written consent.

12. Insurance

We maintain commercial general liability and professional liability insurance appropriate to our scope of services. Certificates of insurance naming the client as extra insured are available upon written request and at no cost for active engagements. Coverage limits are disclosed on certificates and are appropriate for the scope and risk profile of the work we do.

13. Force majeure

Neither party is liable for delays or failures to do caused by events beyond reasonable control. This including natural disasters, severe weather, public health emergencies, government action, labor disturbances, utility outages, telecommunications failures. Or transportation disruptions. The affected party will give prompt notice and use commercially reasonable efforts to resume performance. If a force majeure event continues for more than 30 days, either party may end the affected Engagement on written notice without further liability except for fees earned for work completed before termination.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles. The parties first agree to attempt good-faith resolution by direct discussion. Any unresolved dispute will be brought exclusively in the state or federal courts located in or serving Pasquotank County, North Carolina, and the parties consent to personal jurisdiction in those courts. Each party waives any right to a jury trial.

If you are a government entity, federal regulations applicable to the Engagement (including FAR/DFARS and EM 385-1-1 administrative provisions, where applicable) control over any conflicting provision of these Terms. Nothing in these Terms prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the most recent change. For material changes that affect existing clients, we will provide notice through the Site, by email, or both. Continued use of the Site or engagement of services after an update constitutes acceptance of the updated Terms.

16. Miscellaneous

These Terms, together with the applicable Engagement and our Privacy Policy, constitute the entire agreement between the parties on the subject matter and supersede prior negotiations or representations not expressly incorporated. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent. We may assign in connection with a merger, acquisition, or sale of assets.

Section headings are for convenience only and do not affect interpretation. The parties’ relationship is that of independent contractors. Nothing in these Terms creates a partnership, joint venture, or employment relationship.
